Terms of Service

1. Acceptance

By using DarkTraffiK, you agree to these terms. If you do not agree, do not use the service. DarkTraffiK is operated by Agent Smith AI. Contact: hello@agentsmith.uk

2. The service

DarkTraffiK provides AI funnel measurement and content gap analysis tools. The service is provided "as is." We make reasonable efforts to maintain uptime and data accuracy but do not guarantee either.

The free reveal tool at /reveal is provided without warranty. Signal 1 analysis is based on publicly accessible data (robots.txt, homepage metadata). Signal 2 citation checks are indicative, not exhaustive. Signal 3 (GA4) data analysis is based on data you provide.

3. Subscription

Annual subscription: Solo ($79/yr early bird, normally $99/yr), Studio ($149/yr early bird, normally $199/yr), and Agency ($229/yr early bird, normally $299/yr) are annual subscriptions covering the Measurement Layer. Early bird rates are locked in for active subscribers. Subscriptions renew annually unless cancelled before the renewal date.

Pro add-on: The Pro subscription ($19/mo early bird, normally $29/mo) grants access to the Action Layer for the duration of the active subscription. Cancelling Pro removes Action Layer access; Measurement Layer access continues under your annual plan.

4. BYOK (Bring Your Own Key)

Content generation and citation checks that use AI models run on your own API key. You are responsible for your API key usage and costs with your chosen AI provider. DarkTraffiK does not store, proxy, or mark up AI usage. Your key, your cost, your data.

5. Your data

You retain ownership of all data you bring to DarkTraffiK — your crawler logs, GA4 exports, and generated content. You grant us a limited licence to process this data to provide the service. We do not claim any rights to your content or data beyond what is necessary to operate the service.

6. Acceptable use

You may not use DarkTraffiK to analyse domains you do not own or have explicit permission to analyse. You may not use the service to generate spam, deceptive content, or content that violates applicable laws. You may not attempt to reverse-engineer or circumvent the service.

7. Payment and refunds

Annual subscription fees are non-refundable after 14 days. If the product materially fails to function as described within 14 days of purchase, contact hello@agentsmith.uk for a full refund. Pro subscriptions can be cancelled at any time; no partial-month refunds are issued. Early bird rates are locked in for the lifetime of your subscription.

8. Limitation of liability

DarkTraffiK's liability is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages. GEO recommendations are provided for informational purposes; we do not guarantee citation outcomes.

9. Changes

We may update these terms. Material changes will be communicated by email (if you have an account) with 30 days notice. Continued use of the service after that period constitutes acceptance.

10. Governing law

These terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales.
